Uniunea Avocaților din R. Moldova solicită Parlamentului R. Moldova să respingă amendamentul depus de președinta Comisiei juridice numiri și imunități, Olesea Stamate, prin care apărătorii vor fi lipsiți de imunitatea pe care o au. În acest sens, avocații din R. Moldova au declanșat grevă japoneză pentru perioada 18 - 19 ianuarie curent.
Astfel, avocații vor purta în instanțe, astăzi și mâine, o banderolă albă pe brațul stâng.
„În cazul în care Parlamentul R. Moldova nu va admite solicitarea noastră de a retrage amendamentul Olesei Stamate, atunci vom declanșa greva generală pentru perioada 20 - 24 ianuarie curent, cu sistarea totală a activității de avocat, inclusiv a activității avocaților în cadrul sistemului asistenței juridice garantate de stat”, se arată în hotărârea Uniunii Avocaților din R. Moldova.
De menționat că Olesea Stamate propune abrogarea aliniatului II din art. 52 în care se arată că „avocatul nu poate fi reținut, supus aducerii silite, arestat, percheziționat fără acordul prealabil al Consiliului Uniunii Avocaților, cu excepția infracțiunii flagrante”.
Stamate susține că această modificare a legislației a fost adoptată „mai pe sub masă” și de aceea trebuie abrogată. „(Ne)surprinzător, această modificare propusă de Marina Tauber instituia o imunitate disproporționată avocaților, astfel încât art. 52 alin. (2) din Legea avocaturii la moment sună în felul următor: Avocatul nu poate fi reținut, supus aducerii silite, arestat, percheziționat fără acordul prealabil al Consiliului Uniunii Avocaților, cu excepția infracțiunii flagrante. Dorim să avem un mecanism eficient și echilibrat pentru toți actorii din justiție, iar un asemenea mecanism nu presupune să construim ziduri de protecție împotriva abuzurilor, ci soluționarea lor”, a explicat luni deputata Olesea Stamate.
La rândul său, ministrul Justiției, Sergiu Litvinenco, consideră că, după amendarea legislației la inițiativa deputatei Partidului „Șor”, Marina Tauber, avocații au fost egalați cu deputații în ceea ce privește imunitatea acestora. Anume din acest motiv guvernarea intenționează să anuleze prevederea din Legea cu privire la avocatură, potrivit căreia „avocatul nu poate fi reţinut, supus aducerii silite, arestat, percheziţionat fără acordul prealabil al Consiliului Uniunii Avocaţilor, cu excepţia infracţiunii flagrante”, fapt ce a stârnit nemulțumiri în societate.
Totuși, după valul de nemulțumiri ale avocaților și unor reprezentanți ai societății civile, Litvinenco a propus și o „formulă de compromis” – „păstrarea imunității, însă ea să nu se aplice în cazul bănuielii rezonabile de săvârșire a infracțiunilor de corupție și a celor flagrante”.
